Terms of Use / Copyright

The J. Paul Getty Trust, including the J. Paul Getty Museum, the Getty Research Institute, the Getty Conservation Institute, the Getty Foundation, and Getty Publications (collectively, "the Getty"), has created and maintains the Getty websites in order to provide artistic and scholarly information and resources to the public via the Internet. By using the sites and their content you are agreeing to comply with and be bound by the following terms, which the Getty may change at any time.

On This Page

The Getty Websites Are Proprietary to the Getty
Other than the open content images identified on the website for unrestricted downloading and the portions of the website expressly made available under a Creative Commons license (both described below), all of the text, images, marks, logomarks, and other content of the Getty websites ("Site Content") are proprietary to the Getty or used consistent with the owner's permission or applicable law or regulation. The Getty authorizes you to view, download, and print the Site Content subject to the following conditions:

(1) You must adhere to any and all additional terms or restrictions provided within individual sections of the websites relating to particular Site Content;

(2) Unless otherwise restricted, you may only do so for your own personal and noncommercial use, or for fair use as defined in the United States copyright laws;

(3) Using Site Content for commercial purposes is prohibited;

(4) Using Site Content for personal websites is subject to review and approval by the Getty provided your site takes no advertising and has no commercial sponsors, does not charge a fee for services, and does not offer any product or service for sale including your own works. Requests for personal website use should be directed to Communications@getty.edu;

(5) You may not remove any copyright, trademark, or other proprietary notices, including, without limitation, attribution information, credits, and copyright notices that have been placed in or near the Site Content by the Getty;

(6) You may not modify the Site Content; and

(7) Any displays or printouts of the Site Content must be marked "© [insert year of display or printout] The J. Paul Getty Trust. All rights reserved."

All parties downloading, printing, or using the Site Content in any manner represent and warrant that their use will be consistent with this license and that they will not infringe or violate the rights of any other party or breach any contract with or legal duty to any other parties.

Getty Publications Virtual Library
Getty Publications Virtual Library provides digital copies of select Getty publications, including many titles that are now out of print. All publications appear as they were originally published, with no changes made to the content or design.

Publications in the Virtual Library are available to individuals for private study, scholarship, and research purposes only; reproduction and distribution, even for non-commercial use, is prohibited. Downloading material for any commercial use is prohibited. The Getty owns the copyright for the books; individual images and texts within these publications may also be separately protected by the copyright of their respective creators or other third parties and may require further permissions for use outside the scope of the publications in which they are contained.

The Getty makes no warranties or indemnification relating to your use of the digital publications in the Virtual Library. All parties downloading, printing, or using the content from the Virtual Library represent and warrant that their use will be consistent with applicable laws including, without limitation, copyright, privacy, and publicity laws, and that they will not infringe or violate the rights of any other party. All rights not granted by the Getty are specifically reserved. The Getty reserves the right to withdraw any title from the Virtual Library and to discontinue this program in its entirety.

For permission to use materials in the Virtual Library in ways not covered here, please email pubsrights@getty.edu. For all other questions about Getty Publications and the Virtual Library, email us at pubsinfo@getty.edu.

Creative Commons
Some pages and portions of this website are expressly licensed under a Creative Commons (“CC”) license. Each such page or portion will be clearly marked with the specific type of CC license that applies, including a link to the text of the license. You are free to make use of these pages and portions under the terms of the applicable CC license. Read the terms of the applicable license carefully and note that individual elements of a page or portion (for example, an image from a third party) may be excluded from the CC license. Excluded items will be clearly identified.

Open Content Images
The Getty makes available, without charge, all available digital images to which the Getty holds the rights or that are in the public domain to be used for any purpose. No permission is required.

Some images may include people or objects for which a third party may claim rights such as trademark, copyright, privacy, or publicity rights. The Getty does not warrant that all of the images designated for downloading are free from rights claimed by third parties. As the user, it is your responsibility to ensure that there are no restrictions based on third party rights. The Getty assumes no liability for your use of these images if a third party makes an infringement claim.

Prior to download of the high-resolution image, the Getty will request that you provide minimal information such as a brief explanation about your planned use of the digital images that you download. This information is governed by our Privacy Policy.

For more information on discovering unrestricted, high-resolution digital images available for download, see our Open Content Program.

To request images and/or permission to publish or quote from the Getty Research Institute's collection, please Contact Library Rights & Reproductions.

The Getty does not distribute or permit reproduction of website text, video, or non-collection images except as expressly permitted above.

J. Paul Getty Museum Collection Online and Copyright
Records and images found in Museum Collection are published from the Museum's collection database. Updates and additions stemming from research and imaging activities are ongoing and published online regularly. All text in the collection records is licensed under a Creative Commons Attribution 4.0 International (CC-BY) License, unless otherwise noted. Images and other media are not covered by the CC-BY license.

The Museum does not hold the copyright to many of the works in its collection, and respects the intellectual property rights held by artists, their estates, and other rights holders. Every effort has been made to accurately determine the rights status of works and their images. For copyrighted works with a known rights holder, a copyright notice is displayed under any available images and as part of the record for the artwork. Sometimes the rights holder for a work cannot be identified or located despite a good-faith diligent search conducted by the Museum. Such "orphan works" are labeled as "Status undetermined" under any available images and as part of the record for the artwork. For some artworks, copyright research is still incomplete. These works are labeled as "Status unknown, research required." Please contact Museum Rights and Reproductions if you have information on the rights status of a work that is contrary or in addition to the information in our records.

Images may be unavailable for a work of art due to contractual reasons, copyright and privacy/publicity restrictions, or because a work has not yet been photographed or is too fragile to be photographed. For records with images, a combination of copyright status and available image quality determines the final image display size on the collection website. The Museum publishes thumbnail-size images of copyrighted works for which it does not have a license to reproduce under fair use. All available images include embedded metadata, accessible under file properties or file information.

Images with "No Known Copyright Restrictions" in The Commons on Flickr
The Getty Research Institute is a member of The Commons on Flickr. The mark of "no known copyright restrictions" on images in Flickr indicates that the Getty is unaware of any current copyright restrictions on the works so designated, either because the term of copyright may have expired without being renewed or because no evidence has been found that copyright restrictions apply.

The images we have shared as part of The Commons are for personal research and enjoyment. The Getty does not warrant that the sharing of these images will not infringe upon the rights of third parties holding rights to these works. It is your responsibility to determine and satisfy copyright and other use restrictions before copying, transmitting, or making other use of protected items. If you have any knowledge about rights holders for any of these works, please contact the Getty Research Institute at grirights@getty.edu, or (310) 440-7390.

It is the policy of the Getty to charge licensing fees for commercial use of these images, which helps fund ongoing efforts to care for our collection. If you are interested in commercial use of the images in The Commons on Flickr, please contact the Getty Research Institute: Contact Library Rights & Reproductions.

Blog/s
The Getty websites sometimes provide blog/s for the exchange of ideas and information.

By posting comments to a Getty blog you agree to avoid abusive and offensive language and to refrain from posting any content that is commercial in nature, advocates for a political cause or legislation, or infringes upon any third party's rights, including privacy, copyright, trademark, or patent. We reserve the right to delete comments and links we find to be inappropriate or offensive or not related to the topic, including, without limitation, links to commercial and political websites. We will review comments prior to posting, but we will not correct spelling, grammar, or factual errors although we may comment on them. We hope you share your thoughts with us. Please note: We may discontinue our blogs at any time. We do not have the ability to remove comments upon your request. By submitting comments, you acknowledge that they will be posted on the World Wide Web. You agree we have the right to quote from your comments in all media now known and hereinafter devised.

By posting or distributing information or material through the blog/s, you expressly abandon any proprietary rights you may have in your comments, and such information or material may be freely copied and distributed by others without your permission. You are responsible for obtaining permission from any third party owner of proprietary material, such as a copyrighted story or a news article written by another person, before you post or distribute such material. The Getty requires you to obtain all necessary permissions before posting or distributing any content on the blog/s.

The Getty does not warrant that use of the materials displayed in the blog/s will not infringe the rights of third parties not owned by or licensed to the Getty. For example, some works may be under copyright by the artist or the artist's heirs holding rights to these works. Such works may not be used in any form; they may not be copied or downloaded without prior permission from the holder of the underlying copyright.

Phone Audio Tours
As part of the phone audio tours, the Getty may invite people to leave comments. Please know that your comments will be reviewed by Getty staff and may be reproduced by the Getty in all media now known or hereinafter devised. If you do not want your comment used, please state that clearly after the prompt.

Unrestricted Forum/s
The Getty websites sometimes provide unrestricted forum/s for the exchange of ideas and information by participants. The Getty does not edit or control the information or materials posted to or distributed through these Forums ("Talk Content"). The Getty is not in any way responsible or liable for Talk Content, and claims no proprietary rights of any kind arising from the posting or distribution of material through these Forums. All other terms of use applying to Blog/s apply equally to the Forum/s.

Links to Third Party Websites Are Not Endorsements
Some Getty websites contain links to third party websites. The linked sites are not under the control of the Getty, and the Getty is not responsible for the contents of any linked site. The Getty provides these links as a convenience only, and a link does not imply endorsement of, sponsorship of, or affiliation with the linked site by the Getty.

Warranty Disclaimer and Limitation of Liability
The Getty makes no representation of any kind regarding the Site Content or any portion thereof. All Site Content is provided in "AS IS" condition, and the Getty expressly disclaims any and all warranties of merchantability or fitness for a particular use.

Digital Millennium Copyright Act Compliance
The Getty complies with the provisions of the Digital Millennium Copyright Act applicable to Internet service providers (17 U.S.C. Section 512). If you have any complaints or objections to material posted on the Getty websites please contact our Designated Agent at the following address:
